Terms of Service

1. SCOPE OF SERVICES

Photographer agrees to provide photography services as outlined in the client agreement or proposal, including coverage time, number of final edited images, and estimated delivery timeline. Any add-ons (albums, second shooters, travel, etc.) will be listed separately.

2. PAYMENT TERMS

A non-refundable retainer is required to secure the booking. Remaining balance is due [X days] before the event/session. Late payments may incur fees. No images will be delivered until the full balance is paid.

3. CANCELLATION & RESCHEDULING

Client may cancel at any time but will forfeit the retainer. Rescheduling due to weather, illness, or emergencies is permitted within reason and subject to availability.

4. IMAGE COPYRIGHT & USAGE

Photographer retains full copyright to all images.

Client receives a limited, non-transferable license for personal use only (e.g. printing, sharing on social media).

Commercial use is not permitted without written permission and additional licensing fees.

Client agrees not to sell, edit, filter, or otherwise alter the images without the photographer’s consent.

5. MODEL RELEASE

Client grants the photographer the right to use images for portfolio, website, social media, and promotional materials. If client wishes to withhold this permission, they must request it in writing before the session.

6. IMAGE DELIVERY

Final edited images will be delivered via online gallery within [X weeks] of the shoot date. Unedited/raw files are not included or available. Image selection and editing are at the photographer’s artistic discretion.

7. LIMITATION OF LIABILITY

In the unlikely event of total failure due to illness, equipment failure, or other unforeseen circumstances, liability is limited to the return of all payments received. Photographer is not liable for missed moments due to factors beyond their control.

8. CLIENT RESPONSIBILITIES

Client agrees to arrive on time and communicate any special requests in advance. A list of must-have shots (if applicable) should be shared at least one week prior.

9. RETOUCHING & EDITING

All delivered images will be color-corrected and artistically edited. Extensive retouching (skin smoothing, background removal, etc.) may be available for an additional fee.

10. GOVERNING LAW

This agreement shall be governed by the laws of Arizona, USA.
